Purpose and acceptance
Swiss Open Data ("the service") is a question-answering application that queries official Swiss open data and presents the results with the help of an AI assistant. By creating an account or using the service, you accept these terms and our privacy policy.
Description of the service
The service determines the relevant official data source, retrieves figures live through the providers' public APIs, and presents an answer as text, charts or a map. Every answer cites its source and terms of use.
The service may be offered in beta or evolve over time; features may be added, changed or removed.
The service is primarily intended for users in Switzerland and is not specifically directed at the European Union or EEA market.
Account
Use requires an account. You must provide accurate information, be at least 16 years old and keep your credentials confidential. You are responsible for activity on your account.
Subscription, credits and payment
During the current private beta, the service is provided free of charge and no payment is collected. We will announce the terms and pricing of any paid plans before they take effect. When paid plans launch, payments will be processed by our payment provider Stripe; Stripe's payment terms will also apply to the transaction.
Unless stated otherwise, subscriptions renew automatically at the end of each period. You can cancel at any time from your billing area; cancellation takes effect at the end of the current period.
Right of withdrawal and refunds
The service provides digital content that is supplied immediately. When you begin using the service during any withdrawal period, you expressly request immediate performance and acknowledge that you lose the right of withdrawal applicable to digital content once performance has begun, to the extent permitted by applicable law.
Refund requests are handled in accordance with these terms and mandatory applicable law. For any billing question, contact hello@swissopendata.com.
Acceptable use
You agree not to:
- use the service for unlawful or fraudulent purposes;
- attempt to circumvent technical limits, bulk-extract the data or overload the infrastructure;
- resell, redistribute or pass off the service as your own without authorisation;
- infringe the rights of third parties or introduce unlawful content.
Data accuracy and AI limitations
Answers are generated automatically from official open data queried in real time. Although we display values as published, answers may contain errors, approximations or omissions, and the AI assistant may produce inaccurate results.
Answers are provided for information only and do not constitute professional advice (legal, financial, medical or otherwise). You should verify any important information against the cited official source before relying on it or making a decision.
Intellectual property
The service, its interface and software components are owned by Digilac Sàrl or its licensors. Official data remains subject to the terms of its respective providers; the attribution shown with each answer is part of those terms and must not be removed.
You keep your rights in the content you enter. You grant us a limited right to process it solely to provide the service.
Availability and changes
We strive to keep the service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue all or part of the service, and we depend on the availability of third-party official APIs.
Warranties and liability
To the extent permitted by law, the service is provided "as is", without warranty of accuracy, fitness for a particular purpose or availability. We accept no liability for decisions made on the basis of the answers.
To the extent permitted by law, Digilac Sàrl's liability is limited to direct damages and capped at the amounts you paid for the service in the preceding twelve months. Mandatory consumer-protection provisions remain reserved.
Termination
You may stop using the service and close your account at any time. We may suspend or terminate your access in the event of a breach of these terms or misuse.
Governing law and jurisdiction
These terms are governed by Swiss law. The place of jurisdiction is the registered office of Digilac Sàrl, subject to the mandatory jurisdictions provided by consumer law.
Changes and contact
We may change these terms; the date at the top of the page shows the last revision and continued use constitutes acceptance. Contact: hello@swissopendata.com.
